1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of GearsTrack at gearstrack.com and associated mobile applications (the "Service"), operated by Nicholas Arendash ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Accounts

To use most features of the Service, you must create an account using a valid email address. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to notify us immediately at [email protected] if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or abusive purposes.

4. The Service

GearsTrack is a vehicle build tracking application that allows you to manage vehicle projects, track parts and bills of materials, log maintenance and timelines, document issues, collect inspiration, and store vehicle information including VIN-decoded specifications.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of material changes.

5. Subscriptions and Payments

5.1 Free and Pro Plans

The Service offers a free tier with core functionality and an optional Pro plan at $3.00 per month that unlocks additional features. Pricing is subject to change with reasonable advance notice.

5.2 Billing

Pro subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. You can cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period.

5.3 Refunds

Because the Service is available on a free tier, we generally do not offer refunds for Pro subscription payments. If you believe you were charged in error, contact us at [email protected] and we will review your case.

6. User Content

6.1 Ownership

You retain all ownership rights to the content you upload, create, or store on the Service, including photos, project data, parts lists, and notes ("User Content"). We do not claim ownership of your User Content.

6.2 License to Us

By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to host, store, and display your content solely as necessary to provide and operate the Service. This license terminates when you delete the content or your account.

6.3 Prohibited Content

You agree not to upload or store content that:

  • Infringes any third party’s intellectual property or privacy rights
  • Contains malware, viruses, or harmful code
  • Is illegal, defamatory, obscene, or promotes violence
  • Is used to harass, abuse, or harm others
  • Violates any applicable law or regulation

We reserve the right to remove content that violates these Terms and to suspend or terminate the accounts of repeat offenders.

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Scrape, crawl, or use automated means to access the Service without permission
  • Impersonate another person or entity
  • Use the Service to send spam or unsolicited communications
  • Reverse engineer, decompile, or disassemble the Service

8. Intellectual Property

The Service, including its design, code, logos, and documentation, is owned by us and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our trademarks, branding, or other proprietary materials except as needed to use the Service as intended.

9. Third-Party Services

The Service integrates with third-party providers including Supabase (authentication and storage), Stripe (payments), and the NHTSA VIN decoder API. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Vehicle information retrieved via VIN decoding is sourced from the NHTSA public API and is provided for informational purposes only. We do not guarantee its accuracy or completeness.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Ohio.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the revised Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
